EU and Turkey dispute resolution at WTO

On November 11, 2021, the panel’s confidential report was given to the parties. The EU requested that the panel stop working and not distribute its findings on December 20, 2021. The EU and Turkey notified the WTO Case Settlement Body (DSB) on March 22, 2022, that they had reached an agreement on the process for “arbitration under Article 25 of the DSU to determine any appeal from any final report” in this dispute. Türkiye began arbitration on April 25, 2022, to “appeal” specific panel rulings and made the parties’ final panel report public.

The arbitrators advised Türkiye to bring the measures determined to conflict with its WTO obligations in the award and the panel report into compliance.

The parties agree to abide by the decision, which is binding and made by Article 25 of the DSU. The DSB doesn’t have to accept the honor.
